The Federal High Court in Abuja has dismissed former Binance compliance head Tigran Gambaryan’s suit against the National Security Adviser (NSA) and EFCC over alleged unlawful detention. Justice Mohammed Umar ruled that Gambaryan’s fundamental rights enforcement claim was an abuse of court process, noting he provided no immunity from Nigerian law.
The judge affirmed that the NSA and EFCC acted within their mandates while investigating money laundering and foreign exchange violations involving Binance. Gambaryan had sought a court order compelling an apology for his detention between February and April 2024, but the court emphasized ongoing criminal proceedings, including remand orders and pending arraignment before Justice Emeka Nwite.
Justice Umar concluded that fundamental rights are not absolute and can be restricted when necessary for lawful investigations. Gambaryan’s suit was therefore dismissed.
